Types of amputation and how they happen.

By cause

  • Traumatic amputation — the limb is severed at the time of injury. Motor vehicle crashes, industrial accidents, oilfield incidents, farm equipment accidents.
  • Surgical amputation — performed during medical treatment because the limb cannot be saved. Crush injuries, severe burns, vascular damage, infection that cannot be controlled.
  • Delayed amputation — performed weeks, months, or even years after the original injury. Failed limb salvage, chronic infection, intractable pain, non-functional limb.

By level

  • Upper extremity — finger amputation, partial hand, transradial (below elbow), transhumeral (above elbow), shoulder disarticulation
  • Lower extremity — toe amputation, transmetatarsal, transtibial (below knee), transfemoral (above knee), hip disarticulation

The higher the amputation level, the greater the functional impact and the more expensive the prosthetic options. An above-knee amputation requires a more sophisticated and expensive prosthesis than a below-knee. A shoulder disarticulation is profoundly more impactful than a finger amputation.

By laterality

Bilateral amputations (loss of both arms or both legs) are profoundly more impactful than unilateral amputations. The remaining limb cannot compensate. Damages are correspondingly higher.

Replacement cycle

Prostheses must be replaced every 3-5 years on average — sockets wear out, components fail, the body changes. Over a 50-year lifespan, that's 10-15 replacement cycles. For a young person with a sophisticated above-knee prosthesis, lifetime prosthetic costs alone commonly run $1-2 million.

  • Maintenance and repairs — $2,000-10,000 per year depending on prosthesis complexity
  • Skin care for residual limb — ongoing

Phantom limb pain — the medical reality.

Most amputees experience phantom limb sensations. A substantial fraction experience phantom limb pain — the sensation of pain in the limb that is no longer there. Phantom pain can be:

  • Intermittent or constant
  • Sharp, burning, throbbing, electric, or crushing
  • Triggered by weather changes, stress, or seemingly nothing
  • Resistant to treatment — many phantom pain treatments have limited efficacy

Phantom pain treatment requires ongoing medical management — medications, mirror therapy, TENS, in some cases targeted surgical interventions. The treatment is generally lifelong. Mental health treatment for the pain itself and for the trauma of limb loss is also typically lifelong.

How phantom pain affects case value

Phantom pain is a real, recoverable damages category. Documentation through treating providers, pain logs, and psychological evaluation is critical. Juries need to understand that the pain is real even though the limb is gone — and that the pain may last forever.

Future medical expenses

Dominated by prosthetic replacement over the lifetime. For a young upper or lower extremity amputee, lifetime prosthetic costs alone run $1-2 million. Plus ongoing physical therapy, residual limb care, phantom pain management, and mental health treatment.

Lost wages and earning capacity

Depends on the type of work. White-collar workers may return to work relatively quickly after lower-extremity amputation. Manual laborers, particularly oilfield/construction workers, may be unable to return to their pre-injury occupation. Vocational expert evaluation is typically required.

Disfigurement

Visible amputation produces disfigurement damages in Texas. Substantial damages independent of the pain and suffering category.

Pain and suffering / mental anguish
